Terms of Use

By using the PaintingsILove.com web site ("Paintings I Love"), a service of Seraline Pty Ltd, you are agreeing to be bound by the following terms and conditions (the "Terms of Use" or the "Agreement").

Image Content Conditions

1. Paintings I Love specialises in hand-created paintings, drawings and printmaking only.
2. No photography, sculpture, 3D, pottery, ceramics, murals, mosaics, textiles, jewelry, digital or computer-created works are accepted. In short, we cater for non-digital, hand-created art using traditional materials painted, drawn or printed on flat canvas or paper. Works created using a computer are not accepted - this includes photos processed through a digital filter so they look like a painting, images created with a tablet device, or real paintings substantially modified in form or color by digital filters.
3. Artistic nudes are accepted - explicit nudity, pornography or adult content are not.
4. You must not create, submit or link any sexually explicit material, racist content or content glorifying violence.
5. You must only upload pictures that you have personally created, and for which you are the copyright owner.
6. The painting or drawing alone should occupy the entire uploaded image, and should not include a frame, digitally-added text or be part of a room, studio or outdoor scene. Photographs of yourself or others can be uploaded on your Settings page, not as part of your portfolio.
7. Although we love all art, we wish to keep our website focussed, therefore content not meeting these terms will be removed without notice.
8. We reserve the right to remove any images or comments not deemed suitable for the site without notice.

Comment & Discussion Conditions

1. Paintings I Love aims to be a welcoming, supportive environment where artists can receive complimentary comments on their works and constructive criticism.
2. The main guiding rule is simply: Be nice.
3. Flaming, abuse, rudeness, disrespect or personal attacks are not allowed or tolerated. Should anyone use inappropriate language, start a personal attack, or engage in hate speech, they may be barred from all further discussions and their account may be removed without notice.
4. Paintings I Love is a site dedicated to visual arts. Discussions on controversial topics, such as politics and religion, can too easily lead to an unfriendly atmosphere. Discussions on such topics are only accepted if they are directly related to the content of art, and the previous rule on abusive language is applied. There are other websites on which to discuss those topics.
5. Artists can delete any comments they don't like on their own pictures. They can also block a member from commenting on their pictures in the future. If someone is blocked by three different people, that person will no longer be able to post any further comments on the site. All blockings are reviewed by the administrators, and should only be used for people that are obviously abusive. Any blocking that appears to be unfair may be removed.
6. Advertisements in comments are not allowed, including links to websites placed as 'signatures' in comments. (An artist's website may be listed in their artist profile, and is automatically shown under all their pictures). Generally speaking, posts made specifically for the promotion of a website, product or service are considered advertising. It does not matter if it is a commercial website, an artist's website, a personal website, a charity or non-profit website, etc. Promoters, retailers, manufacturers, etc. may not post advertisements in the discussions, comments or groups. Posts of this kind will be deleted. You are welcome to buy advertising on this site.
7. Excessive use of capital letters is not allowed, i.e. don't yell. Excessive repeated characters are removed, e.g. do not use lots of asterisks and exclamation points. Use the bold & italic formatting for emphasis within a comment, but not for the whole comment.
8. Creating posts that question or reference administrative decisions, such as comment or picture removals, is not permitted. We are not perfect and if you feel that we have made a mistake, please contact us by email and we will review the situation.
9. So that most people can join in the discussions, we recommend that posts be in English.
10. These conditions apply to all areas of member-entered content, including comments, replies, artist statements, and group or set descriptions.

General Terms

1. You must be 18 years and older to use this site or have permission from a legal guardian. You are responsible for any activity that occurs under your username.
2. You are responsible for keeping your password secure.
3. You must not abuse, harass, threaten, impersonate or intimidate other Paintings I Love users.
4. You may not use the Paintings I Love service for any illegal or unauthorized purpose.
5. Users agree to comply with all local laws regarding online conduct and acceptable content.
6. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, paintings, drawings, prints, profiles or links ("Content") that you submit, post and display on the Paintings I Love service.
7. You must not modify, adapt or hack PaintingsILove.com or modify another website so as to falsely imply that it is associated with Paintings I Love.
8. You must not create or submit unwanted email to any Paintings I Love members ("Spam").
9. You may not share your account with other people. Each member is limited to one account.
10. You must not create multiple accounts, especially for the purpose of voting for your own pictures.
11. To protect the rights of all members, Paintings I Love has automatic processes in place to detect unfair voting activity. Fraudulent and unfair voting practices may result in account removal without notice.
12. You must not reverse engineer Paintings I Love services or use any third-party tools or scripts to access Paintings I Love in an undesired way.
13. You must not use Paintings I Love in any way that could damage, disable, overburden, or impair the Paintings I Love service, servers or voting system.
14. You must not transmit any worms or viruses or any code of a destructive nature.
15. You must not, in the use of Paintings I Love, violate any laws in your jurisdiction, including, but not limited to, copyright laws.

Violation of any of these agreements will result in the termination of your Paintings I Love account. While Paintings I Love prohibits such conduct and content on its site, you understand and agree that Paintings I Love is a venue and as such is not responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the Paintings I Love service at your own risk.

General Conditions

1. Paintings I Love reserves the right to modify or terminate the Paintings I Love service for any reason, without notice at any time.
2. Paintings I Love reserves the right to alter these Terms of Use at any time.
3. Paintings I Love reserves the right to refuse service to anyone for any reason at any time.
4. Paintings I Love may, but has no obligation to, remove content ("content" includes, for example, pictures, items, item descriptions, comments, and information submitted in the discussions or galleries) and accounts containing content that Paintings I Love determine in Paintings I Love's sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property, the Terms of Use, the Privacy Policy or other policy documents and community guidelines as posted on Paintings I Love.
5. Paintings I Love does not control any Content delivered via the web site and related services by you or other users, and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the web site, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Paintings I Love be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the web site and/or associated services.
6. The opinions expressed in postings or other Content on this web site are not necessarily those of Paintings I Love or its content providers, advertisers, sponsors, affiliated or related entities. Paintings I Love makes no representations or warranties regarding any information or opinions posted to or otherwise included on or transmitted through the web site. Paintings I Love does not represent or guarantee the truthfulness, accuracy, or reliability of any Content or determine whether the Content violates the rights of others. You acknowledge that any reliance on material posted by other users will be at your own risk.
7. You acknowledge that Paintings I Love is not obligated to pre-screen, regularly review, monitor, delete or edit the Content of the web site. However, Paintings I Love reserves the right to do so at any time at its sole discretion, either itself or through its designees, for any reason or no reason, and to edit or delete any posting or submission with or without notice. Without limiting the foregoing, you agree that Paintings I Love and its designees have the right to edit or remove any Content that violates the Terms Of Use or that Paintings I Love otherwise finds objectionable. Paintings I Love is not responsible or liable for damages of any kind arising from any Content, or from Paintings I Love ’s alteration or deletion of any Content, even when Paintings I Love is advised of the possibility of such damages.
8. Your account will be terminated, without prior notice, if your account is used for hosting graphic elements of web page designs, icons, smilies, buddy icons, forum avatars, badges and other non-photographic elements on external websites.
9. You can remove your profile at any time by deleting your account. This will also remove any private information, pictures, votes and comments you have stored in the system.
10. By uploading images and item description content to Paintings I Love, you agree to allow other Paintings I Love users to view them and you agree to allow Paintings I Love to display the images and content on Paintings I Love (for example, on your profile page, on Paintings I Love's Homepage and as images related to other images) and store the images, item description, profile and other content.
11. Accounts created with the primary intention to promote a product or service will be deleted.
12. To maintain a stable system and provide the highest level of service for all active members, accounts or pictures that have been inactive for 12 months or more may be automatically deleted by Paintings I Love.

You must agree with and accept all of the terms and conditions contained the Terms of Use, the PaintingsILove.com Privacy Policy, and other policy documents and community guidelines as posted on Paintings I Love before you may become a member of Paintings I Love. These policy documents and community guidelines include those terms and conditions expressly set in this Agreement and those incorporated by reference.

Paintings I Love may amend the Terms of Use and any other policy documents and community guidelines, at any time by posting the amended terms on Paintings I Love.

Membership Eligibility

Paintings I Love's services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Paintings I Love's services are not available to children (persons under the age of 18) or to temporarily or indefinitely suspended Paintings I Love members. If you are a under the age of 18, you can use this service only in conjunction with, and under the supervision of your parents or guardians. If you do not qualify, please do not use Paintings I Love. Further, your Paintings I Love account (including feedback) and User ID may not be transferred or sold to another party. If you are registering as a business entity, you personally guarantee that you have the authority to bind the entity to this Agreement.

Release

In the event that you have a dispute with one or more users, you release Seraline Pty Ltd (and Seraline Pty Ltd's officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Privacy

Paintings I Love does not sell or rent your personal information to third parties. Paintings I Love only uses your information as described in the Privacy Policy.

No Warranty

Seraline Pty Ltd, Seraline Pty Ltd's subsidiaries, officers, directors, employees and Seraline Pty Ltd's suppliers provide Seraline Pty Ltd's Paintings I Love web site and services "as is" and without any warranty or condition, express, implied or statutory. Seraline Pty Ltd, Seraline Pty Ltd's subsidiaries, officers, directors, employees and Seraline Pty Ltd's suppliers specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.

Liability Limit

Seraline Pty Ltd shall under no circumstances be liable to any user on account of that user's use or misuse of Seraline Pty Ltd's services. Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract or otherwise. Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on Seraline Pty Ltd's services, from inability to use Seraline Pty Ltd's services, or from the interruption, suspension, or termination of Seraline Pty Ltd's services (including such damages incurred by third parties). Such limitation shall apply notwithstanding a failure of essential purpose of any limited remedy and to the fullest extent permitted by law.

Some rights vary from country and jurisdiction, so some of the above limitations may not apply to you.

Indemnity

You agree to indemnify and hold Seraline Pty Ltd and (as applicable) Seraline Pty Ltd's parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of your breach of this agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

Legal Compliance

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase, solicitation of offers to purchase, and sale of items.

These Terms of Use will be governed by and construed in accordance with the laws of NSW, Australia, without giving effect to the conflict of law provisions or your actual state or residence. Place of Jurisdiction shall be, if legally permitted, NSW, Australia. If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.

No Agency

You and Seraline P/L are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
